Criminal Appeals

About

If you feel a bench officer has made a prejudicial error in the decision reached on a case pending in this court, then you may file an appeal. An appeal is an application for review by a higher court or person to review a decision of a subordinate court or person. Appeals can continue up to the Supreme Court, where the decision is final and can no longer be appealed. An appeal is not a re-trial. You will not be permitted to introduce new evidence. To learn more about appeal procedures for Misdemeanors, you should read rules 8.800-8.816 and 8.850-8.890 of the California Rules of Court. Rules 8.900-8.923 pertain to procedures for Infraction Appeals.
